In the end of 2011, Rossen Baltov requested information on the number of refusals issued by the justices for registration in the Varna District Court. He also sought the number of delivered rulings by the Varna District Court on those refusals for registration.
According to the Director of the Regional Office of the Registry Agency in the town of Varna, the requested information was related to the administrative services provided to the citizens and thus the Access to Public Information Act was not applicable and he did not respond to the access to information request filed by Rossen Baltov.
In a decision as of October 2012 (in Bulgarian), the Administrative Court – Varna, however, found that the silent refusal on an access to information request is inadmissible legal inaction of the administrative body. The court repealed the refusal and returned the request to the Regional Office of the Registry Agency for issuing an explicit decision on the request.
