The request was filed by the journalist Mirela Veselinova from the Legal World magazine. She sought information if the minister of justice had signed orders for additional material stimulus for the ministerial officials; what the total amount of those stimuli were; on what grounds were such bonuses administered; for what period; how many officials did receive such bonuses; what is the highest and what the lowest bonus; did the members of the political cabinet receive bonuses.

 

The Ministry of Justice issued a decision for complete disclosure of the information but in practice the provided information did not correspond to the requested. That is why the decision of the senior legal officer of the Ministry of Justice was challenged in the court.  

 

In their judgment of decision No. 5492 as of October 18, 2012 (in Bulgarian), the Administrative Court Sofia City justices found that the formal decision granting access to information did not contain information on any of the questions put forward in the request. The comparison of the information requested by the journalist and the information provided showed not partial provision but no provision at all. That is why the court repealed the refusal and returned the request for reconsideration to the Ministry of Justice.
