The information was requested by the citizen Ivan Petrov but refused on the grounds that the information amounted to personal data of the employees who had worked overtime and could not be provided without their consent. Furthermore, the request was for access to documents, while the Access to Public Information Act provided for access to information only.
The refusal was challenged before the court with the legal help of AIP.
By a Decision No. 1378 (in Bulgarian) of 6 March 2014, the Administrative Court Sofia – City repealed a refusal of the Sofia Municipality to provide access to the requested information. The court held that the information on overtime work under an employment relationship and for the benefit of the Sofia Municipality does not constitute personal information or personal data of employees. In addition, the court stated that there is an overriding public interest since providing this information would lead to increased transparency and accountability of the Municipality.
